By accessing or using ATLAS ("the Service"), a product of ArcSense Consulting Inc. ("ArcSense", "we", "us", "our"), you agree to be bound by these Terms of Service. If you are using ATLAS on behalf of an organization, you represent that you have the authority to bind that organization to these terms.
We may update these terms from time to time. If a change is material, we will provide notice through the Service. Continued use after notice constitutes acceptance.
ATLAS is a strategic operations platform that helps organizations connect strategy to execution and govern emerging technology responsibly. It is provided on a free or paid subscription basis to registered organizations.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with reasonable notice wherever possible.
Paid plans are billed in advance on a monthly or annual cycle. Annual plans are billed up-front at a discount to the monthly rate. There are no setup fees.
Monthly plans may be canceled or downgraded at any time; cancellation takes effect at the end of the current billing period, and we do not issue partial refunds for the remainder of that period. No further charges will be made after cancellation.
Annual plans may be canceled within 14 days of the initial purchase for a full refund. After that window, annual fees are non-refundable, including on early cancellation or downgrade, but you will retain access to the Service through the end of the paid term.
Advisory hour top-ups and other one-time purchases are billed at the time of purchase and are non-refundable once bought, whether or not the hours are used.
If we materially fail to provide the Service as described in these terms, contact info@arcsense.ca — refund requests outside the policy above are considered on a case-by-case basis.
You must provide accurate information when creating an account. You are responsible for maintaining the security of your credentials and for all activity that occurs under your account.
Each organization on ATLAS operates in a logically isolated environment. Users belong to an organization and can only access data within that organization unless explicitly shared.
ArcSense makes no claim of ownership over any content, data, or information you enter into ATLAS ("Your Data"). Your Data remains yours — and your organization's — at all times.
We do not use Your Data to train machine learning models, sell it to third parties, or share it with anyone outside ArcSense and the service providers necessary to operate the platform.
You may export or delete Your Data at any time. Upon account or organization deletion, we will remove Your Data from our active systems in accordance with our data retention practices described in our Privacy Policy.
You agree not to use ATLAS to: violate any applicable law or regulation; upload or transmit content that infringes on third-party intellectual property rights; attempt to gain unauthorized access to any part of the Service or another organization's data; interfere with the integrity or performance of the Service; or use the Service to store or process content that is unlawful, harmful, or abusive.
We reserve the right to suspend or terminate accounts that violate these standards.
ATLAS and its underlying software, design, and documentation are owned by ArcSense Consulting Inc. and are protected by applicable intellectual property laws. Nothing in these terms grants you a right to use ArcSense's trademarks, logos, or brand features.
You retain all rights in Your Data. By submitting data to ATLAS, you grant ArcSense a limited, non-exclusive license to store, process, and display it solely to provide the Service to you.
To the fullest extent permitted by applicable law, ArcSense shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, even if advised of the possibility of such damages.
Our aggregate liability to you for any claim arising under these terms shall not exceed the amounts paid by you to ArcSense in the twelve months preceding the claim.
These terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles.
Any disputes will be resolved in the courts of British Columbia, Canada, and you consent to the personal jurisdiction of those courts.
